What Happens if TDS is Not Deducted?
Under Section 201(1), the deductor is treated as an assessee-in-default. The deducted amount becomes a debt owed to the government. Under Section 201(1A), interest is charged from the date of deductibility. Section 271C allows a penalty equal to the TDS amount for wilful failure to deduct. Additionally, the expense may be disallowed under Section 40(a)(ia) while computing business income.
Interest on Late Deduction & Payment
1% per month (or part thereof) — interest for failure to deduct TDS, calculated from the date on which tax was deductible to the date of actual deduction.
1.5% per month (or part thereof) — interest for failure to deposit TDS after deduction, calculated from the date of deduction to the date of actual deposit.
TDS vs TCS — Key Differences
TDS is deducted by the payer from payments made (salary, rent, fees). TCS is collected by the seller from the buyer at the time of sale (scrap, minerals, motor vehicles, overseas remittances). TDS applies to a wider range of transactions; TCS is limited to specific goods and remittances under Section 206C.
How to File TDS Returns
Prepare the applicable form (24Q for salary, 26Q for non-salary, 27Q for NRI payments) using TRACES-compatible software. Validate the file using the FVU (File Validation Utility), then upload on the TRACES portal or through an authorised TIN-FC. Each return needs a valid challan reference (BSR code, date, serial).
Lower Deduction Certificate (Section 197)
If your estimated tax liability for the year is lower than the TDS being deducted, you can apply for a Lower Deduction Certificate by filing Form 13 online through the TRACES portal. The Assessing Officer may issue a certificate authorising TDS at a lower rate or nil rate. The certificate is valid for the specific financial year and for the particular deductor named in it. Common cases include freelancers with low total income, businesses with carried-forward losses, and entities claiming treaty benefits. Apply well before the start of the financial year for seamless compliance.
