It clearly defines the terms of tenancy including rent amount, duration, maintenance responsibilities, and conditions for termination. Required for HRA Claims
If you're a salaried employee claiming House Rent Allowance (HRA) exemption under the Old Tax Regime, you need a rent agreement as proof of rent payment. The Income Tax Department may ask for this document during assessment. For annual rent exceeding ₹1 lakh, the landlord's PAN is also required.

- Karnataka: 1% of total rent + deposit amount
- Delhi: ₹100 for agreements up to 5 years
- Tamil Nadu: 1% of the annual rent
- Uttar Pradesh: 2% of the annual rent
- Telangana: 0.4% of total rent for the agreement period

11-Month vs Longer Agreements
Most rent agreements in India are made for 11 months to avoid mandatory registration. Agreements for 12 months or more must be registered with the Sub-Registrar's office, which involves additional fees (typically 1% of annual rent) and both parties visiting the office. An 11-month agreement with a renewal clause is the most common and cost-effective approach.
